Aequo defended power generating coal provider in a dispute with the AMCU

Aequo team successfully prosecuted an action involving the dispute of Derzhvuhlepostach State Enterprise with the Antimonopoly Committee of Ukraine regarding the decision on imposition of a fine for alleged anticompetitive concerted actions.

The project purpose was to challenge the decision made by the AMCU whereby it recognised a violation of the competition laws by setting baseline prices for power generating coal at the level determined by the Ministry of Energy and Coal of Ukraine, which fact allegedly resulted in the restriction of competition in the electric power generation market.

The dispute required an efficient combination of Aequo’s expertise in energy, competition law, and dispute resolution practice.
